A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out.
A 3-day notice of intention to evict is a document that gives you notice the landlord intends to evict you. The notice may be a letter, or may be a clearly labeled legal document. The 3-day notice of intention to evict isnt an eviction order. Eviction requires a North Dakota State District Court order.
That if the tenant doesnt move out within 90 days the owner may start a court case to evict them and that they can give their side of the story then. That they have 10 days to talk about the Notice with the landlord. The 10-day period begins on the day that the Notice is properly delivered to them.
So, depending on the court calendar, a landlord could be waiting between three and six weeks before continuing eviction proceedings. Once youre in court, the eviction proceedings are straightforward. If they cant pay rent thats owed, the court will issue you a Writ of Possession.
If the tenant does not pay the rent within 3 days of receiving the 3-day period, he or she must still move out in 30 days. If the tenant does not move out after the 30 days, then the landlord has to file an unlawful detainer case.
