You can revoke a Power of Attorney for any reason, as long as you have the mental capacity to do so. Reasons to do so may include: You no longer trust the person you appointed as your attorney. You have found a more suitable person to act as your attorney.
The death, incapacity or bankruptcy of the donor or sole attorney will automatically revoke the validity of any general power of attorney (GPA). GPAs can be revoked by the donor at any time with a deed of revocation. The attorney must also be notified of the revocation or the deed of revocation wont be effective.
Unless the power of attorney provides a different method for an agent s resignation, an agent may resign by giving notice to the principal, to the guardian if the principal is incapacitated and one has been appointed for the principal, and to any co-agent, or if none, the next successor agent.
You can ask the Office of the Public Guardian ( OPG ) to remove an attorney if your lasting power of attorney ( LPA ) is registered and you still have mental capacity to make decisions. You will need to send OPG a written statement called a partial deed of revocation.
A principal may revoke a power of attorney: (a) in ance with the terms of the power of attorney; or (b) by delivering a revocation of the power of attorney to the agent in person or by sending a signed and dated revocation by mail, courier, electronic transmission or facsimile to the agents last known address.
You must use a pen and witness any amendments. If you use a pencil or correction fluid, you will not be able to register your LPA which means it cannot be used. Damage to the form might also invalidate the LPA.
If you are the principal, send a copy to the agent so they know that you ended the power of attorney. If you are the agent, send a copy to the principal so they know that you wont act as their agent anymore. There is an option to delay the revocation for 30 days after you communicate your intent to revoke.
Prepare a written revocation statement with the agents name and the date you made the power of attorney you wish to revoke. Sign the revocation before a notary. You can hand-deliver a copy to your agent or send it by certified mail to prove it was received.
