There is no set period that a couple must live together to establish a common law marriage. Once a common law marriage is established, the couple has the same legal rights and obligations as those who obtained a marriage license and participated in a formal wedding ceremony.
If we have a common-law marriage, and we want to end our relationship, do we have to get a divorce? Once you agree that you are married, with a ceremonial marriage or with a common-law marriage, you are married permanently, unless you obtain a divorce or annulment or one of you dies.
A common law marriage cannot be created in Maryland. A couple cannot acquire marital rights and responsibilities by living together for a particular period of time or holding themselves out as spouses.
