Commission: Because commission payments are considered payment for hours worked, they must be included in an employees regular rate of pay when calculating overtime compensation owed. This is the case regardless of whether the employee is paid on a commission-only basis, paid a salary, or paid an hourly wage.
Under the FLSA, overtime pay is determined by multiplying the employees straight time rate of pay by all overtime hours worked PLUS one-half of the employees hourly regular rate of pay times all overtime hours worked. All overtime work that is ordered or approved must be compensated.
For example, a $12 hourly rate will bring, for an employee who works 46 hours, and receives a production bonus of $46 for the week, a new regular rate of pay of $13 an hour (46 hours at $12 yields $552; the addition of the $46 bonus makes a total of $598; this total divided by 46 hours yields a regular rate of $13).
Heres how wed calculate: Calculate the straight time compensation: Hours x Rate of Pay + Bonus. Then, calculate the new regular rate of pay: $530 / 48 hours = $11.04/hr. Next, calculate the new overtime rate of pay: $11.04 x 1.5 = $16.56/hr. Finally, calculate the total earnings: 40 straight time hours x $11.04 = $441.60.
Non-Discretionary Flat-Sum Bonus Overtime Pay To calculate the additional overtime owed to an employee who earns a non-discretionary flat-sum bonus the employer must divide the employees bonus by the number of non-overtime hours worked by the employee within the bonus period.
If the bonus is discretionary, the amount should not be factored into overtime calculations. However, under the Fair Labor Standards Act, nondiscretionary bonuses must be included in nonexempt employees overtime pay calculations for the period of time that the bonus covers.
