A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out.
Unless the rental agreement provides a shorter notice period, a California tenant must give their landlord 30 days notice to end a month-to-month tenancy.
If you get a 30 or 60-day Notices to Quit, it must be in writing and include: The tenant(s) full name(s) The rental homes address. That the month-to-month tenancy will end in 30 days if theyre giving a 30-day Notice or in 60 days if theyre giving a 60-day Notice.
Are texts considered written notice? If you want texts to be legally binding between both parties, that agreement must be set up beforehand and must be in writing.
Ask for more time to move. If you lose your eviction case, you need to move out (at the latest) 5 days after the sheriff posts a Notice to Vacate on your door. You can: pay the full amount of rent that is overdue, move out voluntarily, make a rent payment plan or moving plan in agreement with the landlord, temporarily stop the eviction by filing for bankruptcy, wait for the sheriffs deputy to show up to your doorstep, or try to fight the eviction in court.
Civil Code Section 1946.2 implements just cause limitations. They prohibit termination without just cause of a tenant who has lived in the unit for at least 12 months. These just causes include both tenant at-fault behavior (such as repeated late rent) and no-fault reasons (like owner move-ins).
