Oftentimes, maternity leave is about 12 weeks long that is, if youre eligible for it (and many people in the U.S. arent). Through the Family and Medical Leave Act (FMLA), the federal government guarantees 12 weeks of unpaid, job-protected leave for the birth of a newborn or adopting a child.
Eligibility Requirements To be eligible for PFL benefit payments, you must have: Welcomed a new child into the family in the past 12 months through birth. Paid into State Disability Insurance (noted as CASDI on most paystubs) in the past 5 to 18 months. Not taken the maximum eight weeks of PFL in the past 12 months.
An Employee, with the agreement of the Employer, may shorten the duration of the six (6) week period following the actual date of delivery by providing the Employer with a medical certificate indicating that resumption of work will not endanger her health.
Without medical complications: You can receive benefits up to four weeks before your expected delivery date and up to six weeks after your delivery. By cesarean section: You can receive benefits up to four weeks before your expected delivery date, and up to eight weeks after your delivery.
If you resign during your maternity leave, you do not have to go into work during your notice period, you can remain on maternity leave. But if you resign after the end of your maternity leave, you should work your notice unless you have agreed to take annual leave or you need to take sick leave.
Californias maternity leave law provides at least 12 weeks of leave to new parents. Employees must provide medical documentation if their employer asks for it. Employees should also inform their employers as soon as possible if they plan to take maternity leave.
If eligible, you can receive benefit payments for up to eight weeks. Payments are about 60 to 70 percent of your weekly wages earned 5 to 18 months before your claim start date.
If you desire more maternity leave than what is outlined by your human resources department or in your company handbook, explain your reasons. For example, if your company doesnt offer paid leave and you can afford to take 10 weeks unpaid, tell your superiors exactly why you need this time off from work.
