An affidavit of heirship is a document used to give property to the heirs of a person who has died. It may be needed if the person did not have a will, or if the will was not approved within four years of their death.
If the deceased left no will (intestate) and there is not a surviving spouse, this form must be completed to enable all heirs to mutually relinquish their ownership of a vehicle to a certain party.
In order to convey any real property or an interest in property in Tennessee, the deed must be in writing, acknowledged by the grantor, and registered in the county where the property is located. The Annotated Code of Tennessee allows for the transfer of real property through the usage of a variety of deeds.
Tennessee law does not recognize transfer-on-death (TOD) deeds. In states that authorize them, TOD deeds allow real estate to automatically transfer to a named beneficiary upon the current owners death. The advantage of TOD deeds is that they do not limit the owners property rights during life.
If a family member has recently passed away owning real property, there may not be a need for a full probate administration. Instead, Tennessee law allows for the filing of a muniment of title and an affidavit of heirship to transfer property.
It does not transfer title to real property. However, Texas Estates Code 203.001 says it becomes evidence about the property once it has been on file for five years. The legal effect of the affidavit of heirship is that it creates a clean chain of title transfer to the decedents heirs.
The Affidavit of Heirship form you file must contain: The decedents date of death. The names and addresses of all witnesses. The relationships the witnesses had with the deceased. Details of the decedents marital history. Family history listing all the heirs and the percentage of the estate they may inherit.
If the owner of the vehicle is deceased, you will need to submit the probated will or a letter from the executor showing you inherited the vehicle. If there is no will, you will need to submit an affidavit of inheritance and a copy of the death certificate.
