hi my name is marco brown i own brown family law here in salt lake city utah im coming and talking to you about the most commonly asked questions about divorce on the internet and this one is can i empty my bank account before divorce so theres the technical answer and then theres the is this a good idea answer and the technical answer is before divorce you certainly can uh its your money and its your spouses money but either one of you can do whatever you want with it so yes is this a good idea probably not so if you think you are getting divorced and you go in and you clear out all the bank accounts and you leave your spouse destitute and then go file for divorce or your spouse files for divorce thats going to come back to the judge and the judge is going to figure that out and the judge is not going to be happy i know because i have had those cases before ive had to walk through a divorce case with a client who has done this sort of thing before not pretty really not pretty

Who Owns the Money? Couples who established bank accounts after the marriage began must divide these accounts equally when seeking divorce. Specific accounts that contain marital funds are the marital property of both parties.
Once a person has agreed to become a joint owner or signer on a checking, savings, or credit card, they cant be removed from the account. If you want an account in your name only, youll need to close the account and apply for a new one. However, we do make exceptions if the person in question is deceased.
Can I do that? Generally, no. In most cases, either state law or the terms of the account provide that you usually cannot remove a person from a joint checking account without that persons consent, though some banks may offer accounts where they explicitly allow this type of removal.
Go back to the bank and politely ask to close the joint account. Then transfer the money to another account in your name only. One catch is that your husband might still claim rights to the money during the divorce proceedings. Be prepared to show that it was really yours and yours alone.
