welcome once again to latos law heres Steve lato Bob sent me a one sentence email and said Steve can you please explain a mechanics lien or a garage keeper lean and Im specifically talking about the liens that have to do with automobiles some states have got mechanics liens and they actually use that in reference to any work done uh for instance on a piece of property you bring in a plumber and he works in your house and you refuse to pay him in some states that Palmer may be able to file a lien against your property to assure that he gets paid if nothing else at least when the home gets sold so Im talking about garage keeper liens or mechanics liens on automobiles because in Michigan they are authorized by MCL 570.301 at sac and theyve been around for a long long time and believe it or not years ago I had a friend who owned a gas station and he also did mechanical work there and at one occasion somebody brought a vehicle in and asked him to do the work sign the authorization did

Court Petition to Release the Property Lien If the lien claimant doesnt remove the invalid lien, and the time has expired to record the mechanics lien and take action to foreclose, you may petition the court for a decree to release the property from the lien.
A person whose company is required to be licensed and who performs unlicensed work as a residential building contractor or remodeler is guilty of a misdemeanor. In addition, an unlicensed person who knowingly violates the law has no right to claim a lien and the lien is void.

In Minnesota, mechanics liens expire 1 year from the date of the lien claimants last furnishing of labor or materials to the project. Claimants must initiate an enforcement action before the expiration deadline.
In Minnesota, typically the mechanics lien attaches to the property not by recording a document against the property, but upon the first visible improvement to the real property. All subsequent lien claimants priority relate-back to that first visible improvement.
If a lien is filed against your property (in the form of a lien statement), it must be filed with the county recorder and a copy delivered to you, the property owner, either personally or by certified mail, within 120 days after the last material or labor is furnished for the job.
