Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
However, the landlord must still give you a 60-Day Notice that they want to stop renting to you. There are several "good causes" or reasons landlords can use to terminate a tenancy or evict a tenant. In all cases, landlords must properly serve a written notice (on paper).
A California month-to-month lease agreement is a short-term rental contract that can be canceled by either the landlord or tenant. If the tenant has been on the property for one (1) year or less, the notice for termination shall be a minimum of thirty (30) days, if more than one (1) year, sixty (60) days.
California law allows landlord to change the terms of a month to month tenancy with proper notice. However, changing is not always as simple as just sending a notice.
Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
The Tenant Protection Act of 2019 (AB 1482) restricts rent increases in any 12-month period to no more than 5% plus the percentage change in the cost of living (CPI), or 10%, whichever is lower. For increases that take effect on or after Aug. 1, 2022, due to inflation, all the applicable CPIs are 5% or greater.
Tenants cannot be evicted for making a complaint against the landlord or for anything discriminatory. Under the Fair Housing Act, it's illegal for landlords to discriminate against a prospective tenant based on sex, race, color, national origin, religion, familial status, or disability.
This means the rental provider cannot make you leave your home before the end of your fixed-term agreement. All 60-day notices to vacate must include documentary evidence from the rental provider to prove the reason in the notice to vacate is legitimate [section 91ZZO].
Tenants in Washington can remain in their rental after the lease expires as holdover tenants, but may face eviction. Tenants in Washington who don't leave their rental after their lease is up become what's known as “holdover tenants.” Landlords can choose to let these tenants stay, or evict them for any reason.
