The Foreign Account Tax Compliance Act (FATCA) is tax information reporting regime, which requires Financial Institutions (FIs) to identify their U.S. accounts through enhanced due diligence reviews and report them periodically to the U.S. Internal Revenue Service (IRS) or in case of Inter-Governmental agreement(IGA),
Who Needs to Comply With FATCA? Form 8938 needs to be filed by any American taxpayer with financial assets totaling $50,000 or more.
Reportable accounts are individual and non-individual accounts that are: held by one or more US persons; or held by certain entities in which one or more US persons hold a substantial ownership or controlling interest.
A financial account maintained by a U.S. payor. A U.S. payor includes a U.S. branch of a foreign financial institution, a foreign branch of a U.S. financial institution, and certain foreign subsidiaries of U.S. corporations. Therefore, financial accounts with such entities do not have to be reported.
FATCA applies to individual citizens, residents, and non-resident aliens. Residents and entities in U.S. territories must file FBARs but dont need to file FATCA forms.
This FATCA filing requirement checkbox is designed to notify the IRS whether the payer is reporting the details of this form in ance with FATCA regulations. In some cases, this box will already be checked when you receive your Form 1099. Otherwise, it will simply be an empty box.
It is mandatory for the customers to provide the FATCA/ CRS information documents sought by the FI.
