The New York Department of State will provide you with a filing receipt. Contact the County Clerk in the same county where your LLC has its principal office. The County Clerk will advise you of two newspapers where you will need to file a notice that youve formed an LLC.
Section 206 of New York LLC law requires that LLCs publish notice of formation in two newspapers (one daily and one weekly) that operate from the same county as the LLCs principal address. The notice of formation is the legal notice that will be published by the newspapers papers you choose.
The Certificate of Publication, filing fee, with the affidavits of publication of the newspapers, must be submitted to the New York Department of State, Division of Corporations, One Commerce Plaza, 99 Washington Avenue, Albany, NY 12231.
You have to run your publication notice in two different newspapers for six consecutive weeks. One newspaper must be a daily newspaper and the other must be weekly. Both newspapers have to be located in the county where your LLCs office is located. You cant choose just any county newspaper for publication.
