Ok, so youve got tenants in your property and you want your property back. How do you serve notice on your tenants? This little video blog is going to go through your main hints and tips. It is only relating to Assured Shorthold Tenancies or ASTs for short, it doesnt apply to Assured tenancies or those tenants with extra protection on their tenancy. Were not going to cover those things today. So, for a normal AST, say for example, fixed term 12 month tenancy, you want your property back in month five because you want to live in it or you want to sell it. Unfortunately you cant, the tenant has signed a 12 month legally binding contract and they can be there for the full 12 months. What you can do is put your notice in writing with at least two months notice serving a section 21 notice to end the tenancy on the final day of the 12 month fixed term. The Notice to Quit must allow the tenant at least 3 (three) full days to move. This means that there must be 3 (three) full days between the date the Notice to Quit is served on your tenant and the last day specified in the Notice to Quit for the tenant to vacate the premises.
Your 3 options at the end of a fixed term are: sign a renewal agreement for a new fixed term. let it become a rolling or periodic tenancy. leave the tenancy.
California Civil Code Section 1946.2 limits the reasons for terminating tenancies where all tenants have occupied the unit continuously for 12 months. When the tenants have changed over time, just cause protections attach when at least one of the tenants has occupied the unit for 24 months or more.
Either you or your landlord can end the month-to-month lease with one months notice. If your landlord wants you to move, you should be given a Notice to Quit for termination of tenancy. If you want to move, give your landlord a written, one months notice. Always keep a copy of your notice for your records.
Your tenancy usually ends on the last day of your fixed term or at the end of your notice period when youve given the correct notice. Youll also need to have left the property and given the keys back to the landlord by the end of your fixed term or notice period.
Notice of Termination of Tenancy means any notice, oral or written, given to a tenant for the purpose of having the tenant vacate a dwelling unit. Sample 1.
