In Michigan, the law allows for faster access to court and a quicker resolution in an eviction case than a lawsuit would usually take. Its illegal for a landlord to evict you without going to court and getting an eviction order first.
If the only reason your landlord sued you is because you owe rent, you can usually stop the eviction by paying your landlord everything you owe. This includes all of the rent approved by the judge, and Court costs, including the writ fee if a writ of restitution has been filed.
If you comply with the demand by paying all the rent due and owing, then, in Michigan, the landlord must not proceed with the eviction (see MCL 600.5714). If you are not able to pay the rent within the time period stated in the notice, then you should talk to your landlord.
If you dont do what is required, your landlord could get an eviction order. You and your landlord have 10 days after the judgment is issued to file an appeal if either of you think the judgment is wrong. If you want to appeal the judgment, you may want to think about hiring a lawyer.
The judgment should also tell you that you must either pay the amount owed or move out of your home. In most cases, you will have 10 days to pay or move out. You may ask for more time if you need it.
Speak to your landlord For example, they might withdraw an eviction application if they accept that rent arrears can be repaid or antisocial behaviour will stop. Its harder for private tenants to negotiate, but try if your situation has changed and you want to stay. For example, if you can now repay rent arrears.
It takes 5 days for the Writ of Possession to be issued by the court. Law enforcement officials have 48 hours to serve this court order to the tenant. After that, the tenant has 10 days to move out of the property.
Tips for Renting After Eviction Understand your situation. Talk to your previous landlord. Try an apartment locator. Find a landlord that doesnt do background checks. Get references. Seek a co-signer. Stay on top of your credit. Be honest.
