A spec is truly and wholly owned by the writer. The writer is the author of the copyrighted work in one of the rare instances where the legal terminology makes perfect sense. As long as the spec is not based on any previous work, the writer also owns the work outright at the outset.

Here are three good reasons why you should go beyond and copyright your screenplay: First, you cannot contest ownership without a copyright. Second, you cannot receive statutory damages if a copyright is filed after you file a lawsuit. Third, within five years of publication the copyright is proof of ownership by date.
If you register a script with the WGA, you have the option of putting a WGA Registered notice on the title page. If you elect to not do so, you should put a Copyright notice on the script whether you have registered with the Copyright Office or not, to prevent an infringer.
Before you start shopping your new script around, its a good idea to register your copyright through the U.S. Copyright Office (USCO). Taking this extra step allows you to officially protect your script from theft, plagiarism, or other forms of infringement.
