A release of liability, also known as a liability waiver or a hold harmless agreement, is a contract in which one party agrees not to hold another party liable for damages or injury. These contracts are common in fields that involve some risk to property, finances, or health.
A participant, such as a customer or an employee, accepts risk and agrees to waive the companys liability for damages associated with inherent dangers. The limitation of liability insulates the company from civil damages if the participant suffers from losses or injuries.
By signing the waiver, or even just taking part in the activity, you agree to give up your legal right to sue them if you suffer harm even if it results from their failure to take reasonable care.
Once signed, it prevents the participant from opening a lawsuit against the company in the event of damage or loss, effectively shifting responsibility for injuries from the company to the customer.
In order to do so, they must take reasonable steps to bring to your attention that by signing a waiver, you are in fact giving up your legal right to sue them. However, another statute, the Consumer Protection Act, precludes an occupier from obtaining a waiver of liability.
If you can prove you were not acting on your own power when you signed the waiver, you can place some of the liability back on the company. A waiver could be void if: You were clearly under the influence of alcohol or drugs when signing. In this case, you should have been prevented from doing the activity at all.
