Thus, whenever a song is broadcast over the radio or on television it is being publicly performed and the station needs permission, typically in the form of a license, from the copyright owner (or a party who has negotiated with the copyright owner).
FCC Restricted Radiotelephone Operator Permit Private or Commercial Pilots who fly outside of the United States, or who wish to operate an HF Radio need to obtain a Restricted Radiotelephone Operator Permit from the Federal Communications Commission or FCC.
A station must obtain a direct license to use sound recordings of the work if the sound recording is played in sequence in its entirety. What licenses does a station need to use music in a podcast? There are no blanket or statutory licenses for use of music in a podcast.
How to Obtain a License. Submit FCC Form 605 along with the appropriate Proof of Passing Certificates to apply. (You do NOT need to submit FCC Form 159 (fee processing form) or any fees.) Many Commercial Operator License Examination Managers (COLEMs) file these documents for applicants who test with them.
When to get permission. If you perform music, play recorded music on the radio, or stream (non-interactive) online, you need to obtain a public performance license. Artists typically do not need to secure public performance rights for radio because they are covered by the station.
As a noncommercial broadcast radio station (that might also stream over the Internet), you cannot simply play any music you want legally; you need permission. Fortunately, you dont have to go around cutting checks to every band whose music you use. Rather, you can pay to license music in bulk.
You can apply for a GMRS license online, or by filing FCC Form 605. The FCC sets license filing fees annually, and licenses are granted for 10 years.
The easiest way to get music for your radio station is directly from the local record labels and music promoters. The music obtained this way is provided free, because you will be promoting that labels artist roster. It is a win-win for both the music industry and the radio business.
The following licenses are issued for the holders lifetime: Restricted Radiotelephone Operator Permit. Restricted Radiotelephone Operator Permit-Limited Use. Marine Radio Operator Permit. General Radiotelephone Operator License. GMDSS Radio Operators License. Restricted GMDSS Radio Operators License.
When it comes to music and radio, whether over the air or the Internet, there are at least two copyrights that are of concern including the musical work and the sound recording. For FCC licensed radio stations not streaming copyrighted music, the only rights involved currently are the musical works (compositions).
