I have it this heather Reynolds Im the founding attorney here at your legacy lives and I wanted to talk a little bit about the power of attorney for child care and their medical care this is for a minor child so if you have a child whos not yet age 18 you need both of these documents in place why because a will doesnt kick in until you pass away and youre thinking thats where the guardians are named well if youre still alive and just on vacation for example were taking a vacation at the hospital for some reason and unavailable to parent your child someone will have to have authority to do so now if you dont have these documents in place the court appoints that someone and it may or may not be someone you would like so now you get the chance to write down who you would choose to play this parental role to take your child to medical services or to enroll them in school or whatever legal aspect they need whether its taking them to classes or picking them up theyre going to need

The only way to become a guardian of the person is by applying to court. Speak to a lawyer if you are considering applying. As part of the court application, you will need to complete a guardianship plan form which explains your plan for the incapable persons personal care that you must follow.
When ruling on an order for custody in the Province of Saskatchewan, the court shall only consider the best interest of the child and those factors that affect the childs well-being, health, and welfare. These factors include, but are not limited to (1997, c.C-8.2, s. 8):
A general power of attorney allows the agent to make a wide range of decisions. This is your best option if you want to maximize the persons freedom to handle your assets and manage your care. A limited power of attorney restricts the agents power to particular assets.
There are two ways in which a person can become a childs guardian, if she or he is not the parent of the child: By a decision of the High Court acting as the supreme guardian of all minors, or In a will that was written by a sole parent or sole caregiver who passed away.
A Legal Guardian cannot be appointed by a parent who is alive, as it is not possible to transfer parental responsibility to another person. For this reason, Legal Guardians are usually appointed in a parents will. The will needs to be signed and dated for the guardianship appointment to take effect.
If you are 18 years of age or older and have an interest in the personal or financial welfare of an adult, you may apply to a Saskatchewan Court of Kings Bench to be appointed as a guardian or co-decision-maker for the adult.
There are 3 types of power of attorney each addresses a different estate planning need.In Ontario, there are 3 different types of powers of attorney you can give someone: A non-continuing power of attorney. A continuing power of attorney for property. A power of attorney for personal care.
