The Employee Polygraph Protection Act (EPPA) prohibits most private employers from using lie detector tests, either for pre-employment screening or during the course of employment.
The legislation will require those who meet the eligibility criteria to take a polygraph test 3 months post release from custody and every 6 months thereafter, unless the test is failed. In such circumstances the offender will be required to take the test more frequently.
In civil courts and tribunals, polygraph tests are not used as evidence in their own right but can sometimes be used to add weight to the evidence of either party. In the criminal courts, lie detector tests are of little use as they are not allowed as evidence, supporting or otherwise.
