Today Im at Innovista Law, the home of the TCPA Defense Force, and Im talking with Ernesto Mendieta, and Im asking him some questions that mobile marketers have questions about when it comes to text message marketing and compliance with the TCPA. So one of the questions we get asked all the time are, What types of messages and/ or businesses are exempt from the Telephone Consumer Protection Act? Ernesto: Yes, I understand the question and one thing that is important to remember before we actually get to the exemptions is to know to what text messages the TCPA is applicable to. Derek: Okay. Ernesto: We have to be talking about robocall-started messages. If you manually text someone, if you grab your phone, text someone, the TCPA wont be applicable. So we have to know that were not talking about those messages. Derek: Okay, so if somebody gets out their phone, text messages a customer, and says, Hey, you know, Id love to see

You cannot send text messages just because you have someones number you have to have consent. The Federal Communications Commission (FCC) enforces rules under the Telephone Consumer Protection Act (TCPA) to protect consumers from unwanted calls or text messages.
Federal laws and regulations state that businesses cannot intentionally or unwittingly text unsolicited spam text messages containing irrelevant marketing information, products, services, or other offers.
While mass texting is by no means illegal, it is heavily restricted. The U.S. government has a long history of regulation, protecting consumer privacy concerning telemarketing and robocalls, and this also extends to texting.
While it was initially designed to protect consumer privacy and regulate telemarketing calls, it has since been updated to include SMS texts. Under the TCPA, marketers must receive express written consent before sending promotional messages to their customers.
On an Android, open your phone app and tap on the three-dot icon in the upper right corner and choose Settings. Tap on Block numbers. You will find several options, including unknown callers, recent calls, or from your contact list. Choose or manually enter a number you wish to block.
Protected messages allows the sender to set specific permissions on a message, such as Do Not Forward or Do Not Print.
On an Android phone, open the text and tap the three-dot icon in the upper right. The steps then vary based on your phone and OS version. Either select the Block number option, or select Details and then tap Block report spam.
Telephone Consumer Protection Act (TCPA) Under the TCPA, companies may not send messages to consumers without their consent. Even if an individual provides their phone number or has a long-standing relationship with the business, the company cannot text the individual if they have not granted written consent.
