It is not a legal waiver - if patients, for example, do not receive enough information on which to base their decision, then the consent may not be valid, even though the form has been signed.
A surgical consent form is used to ensure a patient has been provided with all the necessary information concerning a proposed surgery/special procedure and to document that they agree to undergo the operation. Any risks associated with the procedure and treatment thereafter must be outlined in the form.
Consent should begin with a brief explanation of the planned operation, including the anaesthetic involved. It is wise to describe what the patient may expect to experience during surgery, if under a local anaesthetic.
The law does not set any time-scale for the validity of a form of consent signed by the patient. The form is, in fact, not the actual consent but evidence that the patient is consenting to a particular procedure at a given time.
