It is a simple form, available online or from the land office. In essence, it lists down all the assets and liabilities of the deceased as well as his beneficiaries. After completing the form, it must be signed by the applicant before a commissioner for oaths. Form A must be filed with the land office.
You obtain a short certificate by filing the original Last Will and Testament with the Court of the county where the decedent resided. This filing initiates the process whereby the Court oversees the administration of the decedents estate, or probate of the estate.
If there is a will, the person who is named the executor of the estate can use the small estate affidavit. An executor is the person in charge of giving out the property left in a will. A beneficiary can also use the small estate affidavit if there is not a will.
A procedure called Disposition of Personal Property Without Administration allows beneficiaries to quickly and inexpensively settle a very small estate that is no larger than the deceaseds funeral expenses and medical expenses for the previous 60 days.
Since the affidavit does not need to be filed with the court, there are no filing or court fees. The only cost is likely to be paying to have signatures docHubd. However, a notarys services typically cost $20 or less.

If probate can be avoided with the use of an Illinois Small Estate Affidavit, expect to pay between $500.00 to $1,000.00 in legal fees for advice to the affiant (person signing the affidavit) and assistance executing the affidavit.
You must obtain the form used by the probate court in the county where the deceased was a resident. You can obtain it in person or by accessing your courts self-help center online and downloading the form there. Follow the instructions on the form to complete it.
