An inspection of your rental property one to three times a year within the normal realm. However, you are free to do it even quarterly, provided you comply with the tenancy laws applicable to this situation. No property is immune from maintenance issues. In fact, they are a common occurrence.
Tenants are not required to attend the inspection. But it is a very good idea for them to be there and take part. The landlord must suggest two appointment times for the inspection. The landlord must complete the move-in inspection one week before/after the tenant moves in and moves out.
Timeframes for property inspections The maximum frequency for inspections is once every four weeks. Notice of an inspection must be given to the tenant at least 48 hours before the inspection, and not more than 14 days in advance.
You are paying rent to the landlord for exclusive use as the property as your home and as such you have the right to decide who enters it and when. If a landlord enters your home without permission they are, technically, trespassing, unless they have a court order to allow them otherwise.
Some landlords carry out the first inspection after one month, to satisfy themselves that all is well and this also helps build on the landlord, tenant relationship. Following that the frequency of the inspections should be no less than every three months, to avoid harassment.
Section 31 of the RTA speaks to abandonment. The RTA requires inspection reports to be completed at the beginning and the end of the tenancy. However, good business practices suggest that an inspection should be conducted at least once a year in a long-term tenancy.
Entering the rental premises A landlord may enter the residential rental premises at any time with the tenants consent. Consent can be verbal or written. If the landlord wishes to enter the premises without proper notice, the tenant can deny entry. If the landlord has the tenants consent, no notice is required.
The industry generally considers carrying out periodic inspections at three, four or six monthly intervals, allowing for the changes in seasons and weather conditions which can sometimes cause or reveal issues. Carrying out a periodic inspection will allow you to: thoroughly check and record the state of the property.
Essentially, a tenant has the right to exclude others, including the landlord, from the property. Unless there is an emergency, any access to the property will need to be with the tenants consent. Having a clear line of communication will help to any misunderstandings.
Landlords and their agents or contractors should only carry out work or inspect your home at reasonable times. Youre entitled to: at least 24 hours written notice of an inspection. reasonable notice if someone needs access to your home to carry out repairs.
