my name is Jim - Im a founding member of the law firm of Carlson - LLC and Im here to talk to you today about mechanics liens in Illinois mechanics liens are much like mortgages you may not realize that you have a mortgage to secure your construction debt but if you have a qualifying contract to produce improvements to real estate you have or may have a mechanics lien so whats a qualifying contract a qualifying contract is a contract to improve the real estate as that term is defined in Section one of the mechanics lien act some improvements are obvious for example if you are installing structural steel or painting or installing electrical work these things are obvious there are things however that are not so obvious that are also provided for in section one for example land surveyors professional engineers structural engineers and architects yes even architects for buildings that dont get built are defined to improve the land under section 1 of the mechanics lien act perfect

What is the cost of putting a lien on a home? Ultimately, that depends on the type of lien and where you are filing the lien. In British Columbia, the cost of a builders lien is $5.00 per title and in Ontario it is $8.00. It is similar in other provinces as well.
This is done by filing the proper documentary evidence with the applicable land title registry office. However, registration against the title is not required to preserve the claimants right to the lien. Simply providing the Claim for Lien to the property owner is sufficient.

If you find that there is a lien, it must be removed before you can register the car with your province or territory.
How does a Mechanics Lien work? Provide a pre-lien notice. A pre-lien notice informs the hiring party (and any other relevant parties) of your involvement in a specific project. Provide notice of intent to lien. Create and file the lien. Notify and serve the property owner. Release the lien or seek legal action.
To perfect a lien, an action must be commenced, and the Certificate of Action registered, within forty-five days of a lien having been preserved, in ance with section 36(2) of the Act.
Under the Ontario Construction Lien Act a lien must be registered at the Land Titles Office within 60 days from the date the work is completed or the materials supplied to the project job site.
To register an interest, fill out the form for the type of lien you wish to register and drop it off at a registry agent. Some interests must be registered within specific time frames. You should allow adequate lead time for processing by a registry agent if there are any legislative time limits for registration.
