A revocable trust and living trust are separate terms that describe the same thing: a trust in which the terms can be changed at any time. An irrevocable trust describes a trust that cannot be modified after it is created without the beneficiaries consent or court approval, and possibly both.
You can name a trust anything you like, and the name can be long, short, simple or complicated. When choosing a name, keep in mind that the name will be in the title of any asset held in the trust. This consideration may inspire some to keep the name on the short side.
While the revocable trust offers more flexibility, the irrevocable trust offers certain advantages such as creditor protection. If you want to manage the trust yourself and feel like you may want to modify your trust in the future, it would make sense to go for a revocable trust.
RLT: Revocable Living Trust.
Revocable trusts let the living grantor change instructions, remove assets, or terminate the trust. Irrevocable trusts cannot be changed; assets placed inside them cannot be removed by anyone for any reason. Revocable trusts allow beneficiaries to avoid probate court and guardianship or conservatorship proceedings.
Assets placed under an irrevocable trust are protected from the docHub of a divorcing spouse, creditors, business partners, or any unscrupulous legal intent. Assets like home, jewelry, art collection, and other valuables placed in the trust are guarded against anyone seeking litigation against you.
A living trust can help you manage and pass on a variety of assets. However, there are a few asset types that generally shouldnt go in a living trust, including retirement accounts, health savings accounts, life insurance policies, UTMA or UGMA accounts and vehicles.
The downside of irrevocable trust is that you cant change it. And you cant act as your own trustee either. Once the trust is set up and the assets are transferred, you no longer have control over them, which can be a huge danger if you arent confident about the reason youre setting up the trust to begin with.
