A do-not-resuscitate (DNR) order is a legal document that means a person has decided not to have cardiopulmonary resuscitation (CPR) attempted on them if their heart or breathing stops.
For example, someone with terminal cancer might write that they do not want to be put on a respirator (breathing machine) if they stop breathing. This action can increase their control over their death and their peace of mind, and eventually reduce their suffering.
If a medical professional knows of a DNR and continues with resuscitation efforts, then they can be sued by the family of the patient. This happens often, with a recent jury awarding $400,000 to the family of a patient for Wrongful Prolongation of Life in June 2021.
A DNR order is allowed for any reason. Any adult can request a DNR, including healthy adults. People most likely to use them are those who know in advance that their chance of surviving CPR is very low and/or they dont want to spend their last days on life support.
Question: What happens if you resuscitate someone with a DNR? If you attempt resuscitation on a person who has a valid DNR order, you open yourself up to lawsuit by the estate (read: family) of the person with the DNR order, especially if the attempt is successful and they are indeed brought back to life.
In summary, the minimum requirement in order for a DNR form to be valid is the valid signature and date of the patient, or of their legally recognized healthcare agent in the event that they are incapacitated or otherwise unable to express their wishes. Second, the form must be signed off by the attending physician.
While such official documents are generally respected by EMS personnel (check with your attorney and with the local EMS agency in your county), it is important to keep in mind that most EMTs or paramedics do not have the legal training needed to interpret such documents, and more importantly, do not have the time to
