Section 3(1) of the act states that unless otherwise ordered by the court and subject to subsection (2) and an agreement pursuant to subsection (3), the parents of a child are joint legal custodians of the child with equal rights, powers and duties.
The most common joint custody arrangements include the 2-2-3 plan and the 2-2-5 plan. Both involve spending alternate sets of days with either parent. Also common is the alternate week plan, where the child spends one week with a parent and the next week with the other.
Alternating weeks are one of the simplest 50/50 child custody schedules. In this pattern, one week is spent with Parent A while the following week is spent with Parent B. This keeps parenting exchanges to an absolute minimum while still allowing both parents to have robust relationships with their children.
The short answer is that children can make their own decisions about where they will reside once they docHub the age of majority, which is 18 in Canada.
Shared custody is the best arrangement for some families. Its not best for every family. However, for families who are able to have shared custody, they consider it the best arrangement because it allows children to have frequent and continuing contact with both parents.
When the child turns 12, they have the right to refuse to see a parent. However, the court may require the child to provide legitimate reasons.
The pros of a 50/50 schedule are that the child gets to see both parents an equal amount of time. The cons are that this arrangement doesnt always make sense with parents work schedules and the childs activity schedule.
Most parents choose a 2-2-3 schedule, where kids spend two days, two days, and three days with each parent in a rotating schedule. The weeks rotate so that each parent has some weeks with a larger amount of parenting time.
