What Is a Factoring Agreement? A company and a factor enter into an agreement in which the factor purchases a companys accounts receivable (such purchased accounts are called factored accounts), collects on the factored accounts, then pays the company the purchase price of the accounts.
A factoring contract is an agreement where a small business sells outstanding invoices to third parties known as factors in exchange for upfront cash. When these invoices, or accounts receivable, are paid by clients, the money will go to the factor, rather than the small business itself.
Factoring contracts have a minimum term, plus a notice period for exit. These will determine what you need to do next, although you may be able to terminate it regardless of the terms if you pay a financial penalty. Most contracts are detailed in their instructions for termination.
