Generally, a standard commercial lease includes information about the landlord, tenant, guarantor, rent, lease term, and any additional information that constitutes a term or condition of the lease.
Security of tenure is derived from the Landlord and Tenant Act 1954 (the 1954 Act) and affords business tenants with the right to renew their business lease on the same terms as their previous lease (once it has expired), provided that the landlord cannot satisfy any of the legal grounds for refusal.
Security of tenure only applies to a Tenant who is in occupation of premises used for the purpose of a business. The tenancy must be for a term of more than six months and must not fall into any other exclusion stated in the LTA 1954.
Human rights law mandates that all persons possess a degree of security of tenure, which guarantees legal protection against forced eviction, harassment and other threats.
Why would a landlord want a tenancy to be contracted out? Landlords will often want the tenancy to be contracted out because it means that they can have tighter control over their property. If a tenancy is contracted out a landlord does not need any reason to ask the tenant to leave once the lease expires.
Occupation of business premises usually comes with security of tenure. Essentially, what this means is that the tenant will have the right to request a new lease after the original term of their lease has expired, on the same terms (except for the rent) as it had before.
Why exclude security of tenure? From a landlords perspective the main benefit of excluding security of tenure under the Landlord and Tenant Act 1954 (the Act) is that at the end of the lease, the tenant has no right to remain in the property or to compensation and the landlord is given automatic possession.
