Error: Incorrect Payer Name or TIN A corrected form is NOT required to correct an incorrect payer name (yours or your clients name/company name) or the payers taxpayer identification number (TIN). Instead, you may write a letter containing the following information. Name and address of the payer.
Incorrect payer name and/or TIN (electronic form) An incorrect payer name or TIN on an electronic form can lead to penalties of up to $280 per return. You can avoid penalties by sending a letter to the IRS that includes all the information in the image below.
The IRS instructions for Form 1099 allows you to mask the recipient Taxpayer Identification Number (TIN) on paper copies given to recipients. The recipients TIN is truncated on all 2018 and later 1099 forms except Copy A (Federal) and Copy 1 (State Tax Department).
For forms filed with missing or invalid name/TIN combinations, the IRS assesses $290 per form.
Missing TIN - We consider a TIN to be missing if it is not provided. The IRS also considers a TIN to be missing if it has more or less than nine numbers or it has a letter in place of one of the nine numbers.
If the contractor does not provide a TIN or SSN, leave the box for the TIN or SSN blank on the Form 1099.
Form 1099-NEC requires the payers and recipients name, contact information, taxpayer identification number (TIN), and an account number.
The penalty amount depends on whether the employer takes action to correct the error and when the action takes place. A penalty of $310 per form (for 2024) applies to employers that do not make corrections or make corrections after August 1 of the year in which the form was required to be filed.
