A Taxpayer Identification Number (TIN) is an identification number used by the Internal Revenue Service (IRS) in the administration of tax laws.
If the contractor does not provide a TIN or SSN, leave the box for the TIN or SSN blank on the Form 1099.
If your business fails to issue a Form 1099-NEC or Form 1099-MISC by the deadline, the penalty varies from $60 to $310 per form (tax year 2023), depending on how long past the deadline the business issues the form.
Required by the IRS to obtain a W-9 from Vendors, Contractors or Freelancers as per the W-9 and 1099 Rules. Required to submit 1099 forms on time as per the stated deadlines. Failure to file 1099s based on the refusal to provide a W-9 does not excuse the business from timely filing and could result in penalties.
If a contractor refuses to provide a W-9, you should document your request and consider backup withholding. You want to do this for a couple of reasons - you want to avoid IRS penalties, which can be big, and you want to make it easier to justify the expense (which will reduce your firms income tax).
Penalty for failure to furnish a TIN: If a payee fails to furnish a correct TIN to a requester when it is properly requested, the payee may be subject to a penalty of $50 for each such failure.
You should begin backup withholding immediately if the payee refuses or fails to provide a TIN, or if the TIN provided is obviously incorrect (not 9 digits or contains something other than a number). The CP2100 and 2100A notice includes a list of missing, incorrect, or not currently issued payee TINs.
Form 1099-NEC requires the payers and recipients name, contact information, taxpayer identification number (TIN), and an account number.
