Since our previous communication of June 5, 2023, the U.S. Patent and Trademark Office (USPTO) recently announced in an email to stakeholders that it is pressing ahead with implementation of the $400 non-DOCX filing (surcharge) fee effective January 17, 2024.
A very simple invention might generally cost $3500 in attorneys fees to prepare a non-provisional application. The filing fee for a non-provisional application for a small entity is about $530. Therefore the total cost of filing the application in a 1-step non-provisional route is $4030.
As of January 17, 2024, a non-DOCX surcharge has been effectiveup to USD 400 for large entities, USD 160 for small, and USD 80 for micro entitiesexclusively for non-provisional applications, including continuations and divisions.
DOCX filing is available for the following types of applications: Provisional applications. Utility non provisional applications. US National Stage 371 applications.
Auxiliary PDF documents are an evidentiary copy for DOCX filings of Specification, Claims or Abstract in 35 U.S.C. 111(a) filings in Patent Center.
