There is no way to avoid FATCA if you are an American taxpayer and have assets that are held in foreign financial institutions. Moreover, the penalties for trying to avoid it are harsh.

To be exempt from withholding, both of the following must be true: You owed no federal income tax in the prior tax year, and. You expect to owe no federal income tax in the current tax year.
