A variation (sometimes referred to as a change) is an alteration to the scope of work originally specified in the contract, whether by way of an addition, omission, or substitution to the works, or through a change to the manner in which the works are to be carried out.
The descoping or omission of works (sometimes referred to as negative variations) relates to the removal of part (or, on rare occasions, all) of the works awarded to a contractor or subcontractor, and is a common feature of construction contracts.
Abortive work (or abortive costs or abortive fees) refers to work that has been started or carried out, but is not needed, or is no longer needed, and will not form part of the final development. The work will be wasted.
Errors or omissions refer to any missing or incorrect information in the contract documents. For example, the documents could be missing a code requirement or may specify an incorrectly sized material. They can include anything that is: Not labeled in the documents.
Give advance notice. Dont sit with the decision for longer than you need to. No matter how awful a client has been to you, walking away from a project will probably be a huge inconvenience for them. Give them as much advance notice as possible so they can make other arrangements.
The descoping or omission of works (sometimes referred to as negative variations) relates to the removal of part (or, on rare occasions, all) of the works awarded to a contractor or subcontractor, and is a common feature of construction contracts.
Omission of contract simply means removal of part of the work from the original scope of work. Usually in such situations, the cost of removed work scope is deducted from the original contract value. Therefore as a contractor, you will see reduced final project sum than the original agreed sum due to such omissions.
Under a FIDIC lump sum contract, the BOQ contains items which do not exist in the contract drawings or the specifications; hence, the contractor will NOT execute these items. For this, the Employer or the Engineer decides to issue a VO to omit those BOQ items to reduce the amount of the contract price.
