The Department of Health and Human Services (HHS), Office for Civil Rights (OCR) is responsible for administering and enforcing these standards, in concert with its enforcement of the Privacy Rule, and may conduct complaint investigations and compliance reviews.
During the period, HHS monitors the compliance of the covered entity with the obligations it has agreed to perform.
A corrective action plan (CAP) is an aggressive enforcement action the Office for Civil Rights (OCR) takes in response to a HIPAA-covered entity or business associate that has egregiously violated HIPAA laws. The purpose of the CAP is to correct the underlying compliance issues that led to the HIPAA violation(s).
Covered entities and specified individuals, as explained below, who knowingly obtain or disclose individually identifiable health information, in violation of the Administrative Simplification Regulations, face a fine of up to $50,000, as well as imprisonment up to 1 year.
A resolution agreement is a settlement agreement signed by HHS and a covered entity or business associate in which the covered entity or business associate agrees to perform certain obligations and make reports to HHS, generally for a period of three years.
Those who violate HIPAA may face fines from $100-250,000 per offense (with an annual cap at $1.5 million) and/or a 1-10 year prison sentence. Employers may find it difficult to enforce sanctions on employees who break the rules. However, it is important to do so consistently for the wellbeing of the company.
Every covered entity and business associate is eligible for an audit. These include covered individual and organizational providers of health services; health plans of all sizes and functions; health care clearinghouses; and a range of business associates of these entities.
Violating HIPAA can result in civil or criminal penalties. Civil penalties include fines of up to $1.5 million for repeated violations of a single requirement in a calendar year. The civil penalties are based on a four-tier system of increasing penalties, depending on factors such as willful neglect.
HIPAA currently requires a covered entity to respond to an individuals right of access request within 30 days after receipt of the request, with an option for a thirty day extension upon providing a written explanation with the date by which the entity will complete the request to the requesting individual.
