The polygraph examination is voluntary. The polygraph examiner requires your cooperation throughout the test. As a result, it must remain voluntary. If, for any reason, you dont wish to take the examination, you may decline.
A common question that clients asks me is whether a lie detector is admissible or whether that will help under the Canadian criminal law. The short answer to that is that a lie detector is not admissible in court. It cannot be used either for you or against you.
Occasionally, a suspect will ask to take a test in order to establish his innocence. You are never under any legal obligation to take a lie detector test in a criminal investigation. Even if the police tell you the test is mandatory or threaten to arrest you if you refuse, you dont have to.
Polygraph tests accompany some Top Secret or TS/SCI clearances; however, they are not required to obtain either type of clearance and are not part of the clearance background investigation.
In the criminal context, the Supreme Court of Canada has ruled repeatedly that polygraph evidence is inadmissible because it is unreliable, is a form of oath enhancement and the bolstering of credibility, is hearsay, and is good character evidence.
An employer cannot force a polygraph test. It should always be free and voluntary. An employer conducting a test should ensure that the consent of the employee is obtained in writing and that the possibility of undergoing a polygraph is agreed upon in the employment contract. This will curtail potential disputes.
Under no circumstances can an employee be coerced or bullied into taking a polygraph test. The employee must give consent in writing.
Fortunately, under Canadian law, silence, or refusal to participate in a police investigation is not admissible to prove a persons guilt. Silence is not evidence and it cannot be cross-examined upon its as simple as that.
