In this episode of InventRight TV, hosts Andrew Krause and Damon Kelly, a patent attorney, discuss provisional patent applications. They emphasize the mindset inventors should adopt when filing these applications. Damon highlights common errors, noting that inventors often overwhelmed by information from past patents may fall into a negative mindset. Instead of focusing on potential pitfalls, inventors should concentrate on their own unique innovations. Understanding the correct approach to provisional patents is crucial for protecting ideas without excessive worry about existing patents. The discussion aims to guide inventors to a more constructive perspective in their patent journey.

Below are some common questions from our customers that may provide you with the answer you're looking for. If you can't find an answer to your question, please don't hesitate to reach out to us.

Specifically, 35 U.S.C. 115(a) requires that each individual who is the inventor or a joint inventor of a claimed invention in an application for patent has executed an oath or declaration in connection with the application (except as provided for in 35 U.S.C. 115).
You can submit your application to us either online (eOLF or ePCT), by post, by secure email, or by fax. You can also file other documents, such as your demand, replies to PCT office actions, and subsequent documents, by the above means.
A patent assignment is an irrevocable agreement for a patent owner to sell, give away, or transfer interest to an assignee, who can enforce the patent.
This identity or relationship must be valid at the time the PCT application is filed. Where a U.S. priority document is filed in the name of the inventors and the PCT application is filed in the name of the owner, there must be an assignment from the inventors to the owner prior to the filing of the PCT application.
Patent assignment documents can be searched for - and viewed - by using the United States Patent and Trademark Office Patent Assignment Search webpage.
Use EPAS to create and submit a Patent Assignment Recordation Coversheet by completing on-line web forms and attaching the supporting legal documentation as black and white TIFF or PDF for submission via the internet. You may email questions about filing electronic patent assignments to EPAS@uspto.gov .
The PCT makes it possible to seek patent protection for an invention simultaneously in a large number of countries by filing a single international patent application instead of filing several separate national or regional patent applications.
Disadvantages. The most obvious disadvantage of the PCT application route is that it increases overall costs. In some territories, the PCT application route is slower than direct national applications. However, as this also means that costs are deferred.
