A contract may be deemed void if the agreement is not enforceable as it was originally written. In such instances, void contracts (also referred to as void agreements), involve agreements that are either illegal in nature or in violation of fairness or public policy.
This contract sets out the rights and privileges of each party to the relationship, after which, the agreement is notarised by a notary. This agreement needs to then be signed by both parties in the presence of the Notary Public. Once signed, the couple are issued a notarial certificate.
Most documents and contracts do NOT require a witness for them to be legally valid. However, some documents such as a Will can have clearly regulated requirements pertaining to witnesses.
An unsigned written contract can be binding, although a court will look at all of the circumstances before concluding that the parties intended to be bound. The lack of a signature would normally suggest that the parties had not yet docHubed the point where they were agreeing to be bound.
However, it is to be noted that in case of any legal proceedings, the docHubd agreement cannot be admissible in the Court, as it does not validate the rental transaction. It just verifies the documents furnished along with the agreement.
To be legally valid, a contract must fulfill four basic requirements: All signees must be above the age of consent. All parties must agree to the contract freely. All parties must be able to understand the agreement (legal capacity). The terms of the agreement must be permitted in law.
Generally, contracts need not be docHubd because the signed agreement itself makes it legally binding. The Civil Code also states that a contract is valid and legally enforceable if all elements, namely consent, object, and cause, are present.
Under the Civil Code, a contract is valid and binding if all its elements are present, i.e., the elements of consent, object, and cause. Thus, even if the contract is not docHubd, it is valid provided these elements are present.
