Completing an I-9 as an Authorized Representative The notary will complete the required information in Section 2, including the employers review/verification and certification. Since the completion of an I-9 form is not technically considered a notarial service, a notary public has the option to refuse the service.
Federal law requires that every employer* who recruits, refers for a fee, or hires an individual for employment in the U.S. must complete Form I-9, Employment Eligibility Verification. Form I-9 will help you verify your employees identity and employment authorization.
Generally, you are not legally responsible to answer an employee verification request unless it is issued by a federal group. However, most employers do answer these requests as often as possible, even when not legally required. The most important thing is to only give the information you can legally give.
Remote hires must complete Section 1 of the form, and the employers agent or representative must complete Section 2 completely, including a tactile inspection of the employees documents. This eliminates the need to photocopy documents and send them to human resources for section 2 completion.
The I-9 does not require notarization. Even when notaries were permitted to assist with the I-9, they did not do so as notaries, they did so as a designated representative of the hiring company.
Often, human resource employees and management professionals write these letters, but sometimes an employee might write their own letter.
The Form I-9 does NOT require a notarial act, therefore you must NOT affix your notarial seal impression on it. You are signing the form in the capacity of Authorized Representative of the verifying employer, so we recommend that you indicate Authorized Representative as your title, not Notary Public.
There are different ways to request an employment verification letter from a current or former employer: Ask your supervisor or manager. Contact Human Resources. Get a template from the company or organization requesting the letter. Use an employment verification service.
