Heirship Affidavit Texas Two things must be true for an affidavit of heirship to be used. That is the decedent died without a Will and the decedents only asset when the decedent died was real estate. The real estate must not have been jointly owned and must only have the decedents name in the title.
Once the affidavit has been recorded, the heirs are identified in the property records as the new owners of the property. Thereafter, the heir or heirs may transfer or sell the property if they choose to do so. At that point, the deed most commonly used to transfer the property is a General Warranty Deed.
The Affidavit of Heirship form you file must contain: The decedents date of death. The names and addresses of all witnesses. The relationships the witnesses had with the deceased. Details of the decedents marital history. Family history listing all the heirs and the percentage of the estate they may inherit.
Generally speaking, each spouse has a right to half of the community property and so, this is automatically distributed to a widow after their spouses death. Therefore, the deceased individual only has the right to control their half of the community property estate.
Under Texas Estates Code, Title 2, Chapter 205, an estate need not pass through the probate process if there is no will and the total value of the estate (not counting any homestead real estate owned by the Decedent) is $75,000 or less.
No probate will be necessary to transfer the property, although of course it will take some paperwork to show that title to the property is held solely by the surviving owner. In Texas, two forms of joint ownership have the right of survivorship: Joint tenancy.
Estates Code section 203.001 allows a court to accept an affidavit of heirship as being a true statement of the heirs after it has been on file for FIVE years! That is a long time to wait to make sure your title is good, and even then, someone can offer contrary proof and convince the court otherwise.
