hi everybody Dave sudden and today weamp;#39;re going to talk about character evidence and again what we do here at evidence at trial is we look to not just master the rules of evidence but master them in a way that we can apply them during the heat and speed of trial and so before we get to character evidence I want to remind ourselves of how we approach every evidence question during trial and so this is the prism in which we look at any issue that comes our way we donamp;#39;t just want to wait for these issues to come to us because in the event we do that we may be able to spot obvious issues but miss less obvious but more important issues and so for example if we hear some witness get on the stand and he or she is talking about some out-of-court declarant statement we may think oh thereamp;#39;s thereamp;#39;s a hearsay objection but the reality is there are a number of exceptions to hearsay and we may be missing more obvious but less obvious but more important objections like

At the conclusion of the defendants case, the plaintiff or government can present rebuttal witnesses or evidence to refute evidence presented by the defendant. This may include only evidence not presented in the case initially, or a new witness who contradicts the defendants witnesses.
The exclusionary rule is another rule under which relevant evidence may be excluded, based in part on public policy concerns. It causes evidence gathered by the police from an illegal search to be inadmissible in a criminal case.
Under certain circumstances, relevant evidence will be inadmissible if its probative value is substantially outweighed by the danger of unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative.
Primary tabs. The court may exclude relevant evidence if its probative value is substantially outweighed by a danger of one or more of the following: unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative evidence.
An exclusion is a provision within an insurance policy that eliminates coverage for certain acts, property, types of damage or locations.
There are five major areas of exclusion that arise out of the Federal Rules of Evidence (FRE): subsequent remedial measures, ownership of liability insurance, offers to plead guilty to a crime, offers to settle a claim, and offers to pay medical expenses.
Evidence advanced by a party to show that something did not exist or did not take place, e.g., that a manufacturer accused of selling a defective product had no reports of danger over years of selling the product and thus know knowledge that the product was defective.
Exclusion of Evidence Meaning If a defendants rights were violated, evidence that is subsequently gathered may not be admissible in court. We also have criminal procedures that must be followed for evidence to be admissible in court.
