For example, if blood evidence was not properly preserved or there is a time period during which a piece of evidence is unaccounted for, the evidence is potentially tainted and/or could have been tampered with by just about anyone. As such, it should not be allowed to be introduced at trial.
Photographs may also serve as historical evidence (for example, about the Civil War). And they serve in informal contexts as evidence about all sorts of things, such as what we and our loved ones looked like in the past. Photographs are not, of course, the only sorts of pictures that can furnish evidence.
Photographs are considered secondary evidence. 32 The object or view that the photograph is to represent must be admissible. If the subject of the photograph could not be introduced, the picture of it must be excluded.
In order for photo and video evidence to be admissible in court it must meet two basic requirements: relevance and authenticity. In order for evidence to be relevant it must have probative value. In other words, it must either support or undermine the truth of any point at issue in the legal proceedings.
The court may exclude relevant evidence if its probative value is substantially outweighed by a danger of one or more of the following: unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative evidence.
Photography records a moment in time. Nothing is more crucial than time when trying to solve a crime. Evidence must be inspected on-site, then removed from the scene and analysed, leaving the photographic image as the most accurate and permanent record of the event as it was seen.
Rule 403 provides that a trial judge may exclude proffered evidence if its probative value is substantially outweighed by the danger of unfair preju- dice, confusion of the issues, or misleading the jury, or by considerations of undue delay, waste of time, or needless presentation of cumulative evidence.
