The most common reason for evidence exclusion in a U.S. trial is a Fourth Amendment violation, safeguarding against unreasonable searches and seizures. This violation leads to the application of the exclusionary rule, excluding evidence obtained unlawfully.
The court may exclude relevant evidence if its probative value is substantially outweighed by a danger of one or more of the following: unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative evidence.
A Motion to Exclude or Suppress Evidence (often simplified as Motion to Suppress) is a pre-trial motion requesting that the courts exclude one or more pieces of evidence from the upcoming trial. Under the law, only evidence that is pertinent to your case and legally obtained may be presented at your trial.
Hearsay evidence, forced confessions and prejudicial evidence may also be ruled inadmissible in criminal cases. If youre facing criminal charges, then its important to start thinking about the strength of the evidence against you.
A motion to suppress evidence is a request by a defendant that the judge exclude certain evidence from trial. The defense often makes this motion well in advance of trialif the defendant wins it, the prosecution or judge may have to dismiss the case.
For example, if blood evidence was not properly preserved or there is a time period during which a piece of evidence is unaccounted for, the evidence is potentially tainted and/or could have been tampered with by just about anyone. As such, it should not be allowed to be introduced at trial.
Evidence advanced by a party to show that something did not exist or did not take place, e.g., that a manufacturer accused of selling a defective product had no reports of danger over years of selling the product and thus know knowledge that the product was defective.
Negative evidence, which suggests that an alleged fact does not exist, for example, testimony that a witness did not see the crime occur.
