A registered trademark is granted based on the examination of the exact version of the logo you once submitted, and a change does not automatically mean you have the right to the same level of legal protection; therefore, your updated version would have to be assessed again.
As a matter of fact, it is not possible to add any extra elements (written or visual) to a pending or registered trademark. If you decide to change your brand logo by adding an additional element, it is advisable to submit a new application with the new version of the mark that is currently in use.
Under federal law, you can file a trademark amendment application if your requested change does not materially alter the character of the mark. The modified mark must contain the essence of the original mark. It must also create the same impression as the original mark. This means that the USPTO will consider
Correcting filing errors using online forms Submit the form Section 7 Request for Amendment or Correction of Registration Certificate. See TMEP section 1609 for more information on corrections after registration.
Is it possible to register a trademark in one class at first, and then register another class(es) later? Yes, it is possible to register a trademark in another class later; however, bear in mind that this would need to be a new application for a new trademark. You cant extend classes on a previously filed trademark.
Adding a class to a registered trade mark However, once youve registered your mark, you cant expand the scope of protection - you cant add extra classes or alter the representation of the mark (eg change your logo). You may need to file a new registration to protect your existing trade mark under different classes.
How Do I Amend a Trademark Registration? If your trademark registration is not the subject of a cancellation proceeding, then you can amend your trademark registration by filing a Section 7 Request for Amendment with the USPTO. The Section 7 is an online form that is available on the USPTOs website.
