changes happen at the USPTO from time to time there were new procedures that went into effect earlier this year at the beginning of 2022. last year there were fee increases that went into effect almost every year thereamp;#39;s some kind of change that happens and impacts the USPTO and impacts those of us who file trademark applications at the USPTO but the biggest change that Iamp;#39;ve seen in many many years is about to take place in early December on December 3rd the USPTO is changing the time that most applicants get to respond to an office action and office action is a refusal from the USPTO sometimes itamp;#39;s a big refusal with lots of issues and big substantive things sometimes itamp;#39;s a fairly straightforward refusal might just have one relatively minor procedural issue but for many many years for as long as Iamp;#39;ve been practicing trademark law which is more than two decades when in office action issued the applicant had six months to respond not so anymore s

Under federal law, you can file a trademark amendment application if your requested change does not materially alter the character of the mark. The modified mark must contain the essence of the original mark. It must also create the same impression as the original mark. This means that the USPTO will consider
A trademark owner who believes its mark is being infringed may file a civil action (i.e., lawsuit) in either state court or federal court for trademark infringement, depending on the circumstances. However, in most cases, trademark owners choose to sue for infringement in federal court.
The United States Patent and Trademark Office (USPTO) abandons a trademark application when timely response to an Examining Attorneys office action is not received. You can file a petition to revive an abandoned application if your delay in responding to the office action was unintentional.
Correcting filing errors using online forms Submit the form Section 7 Request for Amendment or Correction of Registration Certificate. See TMEP section 1609 for more information on corrections after registration.
You may challenge an application for trademark registration at the USPTO by filing an opposition with the TTAB within 30 days after it is published in the Official Gazette.
Adding a class to a registered trade mark However, once youve registered your mark, you cant expand the scope of protection - you cant add extra classes or alter the representation of the mark (eg change your logo). You may need to file a new registration to protect your existing trade mark under different classes.
If ownership of the mark has changed you must file an Assignment of Trademark or Service Mark. Registrant must attach a true and correct copy of the original document showing proof of name change, or a copy of the original document filed in another jurisdiction and certified by the filing office of that jurisdiction.
In many instances, amending your trademark application can be done by using the Voluntary Amendment Not in Response to USPTO Office Action form. You can also request amendments to your trademark in a Response to Office Action form if the examining attorney has issued an Office Action.
