At any time, either parent or the childs legal guardian can ask for a change (called a modification) to increase or decrease the amount of court-ordered child support.
How Often Can Child Support Be Modified In California? Under California law, either parent can request to modify child support after every three years, or if there has been a substantial change in circumstances since the order was decreed.
When parents agree on the changes to be made to the parenting plan they may file their agreement (stipulation) for modification with the court. A stipulation means both parents agree the court should make the change. The court may grant the request without a formal hearing depending on the nature of the change.
Every 3 years, you may ask for the Family Support Division to review your child support order to see if you can change the amount you owe. If it has been less than 3 years since the order was started, reviewed, or modified, we will only review your order under special circumstances.
To seek a modification of your child support order, either for an increase or reduction, you must file Form 12.905(b), Supplemental Petition for Modification of Child Support, with the jurisdiction where the original child support order was made. You must sign the form in the presence of a notary or a deputy clerk.
Three Years: A child support modification can be requested once every three years regardless of the above circumstances. If you have your child support agreement put into place less than three years ago then you are going to need to qualify for a modification along one of the paths listed above.
Can I modify child support? Child support is always modifiable under Florida child support law, as long as the change would be at least $50 or 15% whichever is greater. This includes prior orders for child support under a previous divorce, paternity case, or any support order established by the Florida Dept.
Forms to Change a Child Support Order Using a Simplified Motion (Including Response Forms) You need to use either Form FL-150 or Form FL-155. ) to find out if you can use the simpler Form FL-155. A lawyer or family law facilitator can help you decide which form to use.
