A subordination agreement is generally used when there are two mortgages and the mortgagor needs to refinance the first mortgage. It acknowledges that one partys interest or claim is superior to another in case the borrowers assets need to be liquidated to repay debts.
The lender might require a subordination agreement to protect its interests should the borrower place additional liens against the property, such as if she were to take out a second mortgage. The junior or second debt is referred to as a subordinated debt.
Refinancing Your Home Many lenders wont approve this refinance because their loan would be a subordinate loan. Sometimes, the refinance can move forward if the original subordinate loan lender agrees to a new subordinate clause. It might not work out, though.
Subordination is the process of ranking home loans (mortgage, HELOC or home equity loan) by order of importance. When you have a home equity line of credit, for example, you actually have two loans your mortgage and HELOC. Both are secured by the collateral in your home at the same time.
The signed agreement must be acknowledged by a notary and recorded in the official records of the county to be enforceable.
To adjust the priority of a loan in the event of default, a lender may demand a subordination clause, without which loans take chronological precedence. A subordination clause effectively makes the current claim in the agreement senior to any other agreements that come along after the original agreement.
A mortgage subordination refers to the order the outstanding liens on your property get repaid if you stop making your mortgage payments. For example, your first home loan (primary mortgage) is repaid first, with any remaining funds paying off additional liens, including second mortgages, HELOCs and home equity loans.
What is a Subordinate Mortgage? Subordinate mortgages are loans that have a lower priority status than any other recorded liens (or debts) against a property. When you get the loan you need to purchase your home, this loan is typically recorded as the first repayment priority on your deed after closing.
