If the roommate leaving gives proper notice in writing to move out, the tenancy will end for the other co-tenants as well even if they did not sign the notice. The remaining roommates will have to either move out or sign a brand-new tenancy agreement in order to stay.
In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy. The main advantage for tenants with a month-to-month tenancy is that they have much more flexibility if they decide to move.
If you are a leaseholder, you cannot change the lease terms without agreeing such change with your landlord. The reason for this is that as the lease is a contract between two parties, the leaseholder and the landlord, both parties must agree to change (referred to also as variation) of the terms of the lease.
If someone is going to be living with you, then you must inform your landlord. If you dont inform them then you could end up voiding your tenancy or making sections of it invalid. Honesty is the best policy here, and the relationship between you and your landlord is all about trust.
14-Day Guest Policy For example, it is not uncommon for tenancy agreements in BC to have a 14-day per year overnight guest policy. If your agreement contains such a policy, it is likely that an arbitrator at dispute resolution would consider it unconscionable, and therefore unenforceable.
Under an existing tenancy agreement, the landlord can only increase the rent in response to additional occupants if the agreement includes a term allowing the rent to vary by a stated amount based on the number of occupants or the parties all agree to sign a new tenancy agreement.
If the tenants agree to an additional rent increase, the landlord must issue to each tenant a Notice of Rent Increase along with a copy of the tenants signed agreement to the additional amount. Tenants must be given three full months notice of the increase.
During a lease term, both the landlord and tenant can propose amendments, provided theyre familiar with any rules in the Lease Agreement about changing the lease. Once both parties have agreed to the changes, they can be formalized with a Lease Amendment.
