Parental leave. All full-time, part-time and casual employees who have worked for their employer for at least 12 months can take unpaid leave when they have a baby or adopt a child. There are rules around who is eligible and how leave can be taken, but basically - mums and dads can take up to 12 months leave to care for their child. With an option to agree with their employer to take up to another 12 months Parental leave can be split between both parents, as long as the total amount of leave taken, isnt more than 24 months An employee needs to give their employer at least ten weeks notice of their intention to take parental leave and provide evidence if it is required. A maximum of 15 weeks of EI maternity benefits is available. The 15 weeks can start as early as 12 weeks before the expected date of birth, and can end as late as 17 weeks after the actual date of birth.
Dont worry if you change your mind about when to return to work. Just write to your employer with your new dates, and give them plenty of time: to end your leave sooner, tell your employer at least 8 weeks before your new end date.
The Government made amendments to the Maternity Benefit Act of 1961 by extending the maternity leave duration from the former 12 weeks to 26 weeks.
You want to extend the length of your maternity leave and are wondering if you can do it without losing your job. The quick answer is, yes, under Canadian employment law you can change your mind, and the amount of time you are off work, even after your baby is born.
Due to a change in my circumstances, I would like to request an extension to my maternity leave. I would like to change my return date to date, which will be the end of my maternity leave. I understand that I am required to give you 8 weeks notice of my change of plans and I confirm that I am complying with this.
Theres no extended maternity leave option, but instead, you can combine your mat leave with parental benefits. For example, if you take 15 weeks of maternity leave and 35 weeks of standard parental leave, youd be receiving benefits for a total of 50 weeks.
Key Changes Standard Option: parental allowance (top-up) of up to 93% of an employees weekly rate of pay for a maximum of 37 weeks. NewExtended Option: parental allowance (top-up) of up to 55.8% of an employees weekly rate of pay for a maximum of 63 weeks.
Once you have made your selection, you can provide your supervisor with notice if you wish to extend your leave (as long as it does not exceed 78 weeks in total) or return from your leave early.
