In this tutorial, Carla Hartley discusses post-nuptial agreements, defining them as agreements made after marriage that outline the terms for the dissolution of the marriage and division of community estate. She notes that a post-nuptial agreement often signals potential marital issues and compares it to a prenuptial agreement. Interestingly, she points out that post-nuptial agreements are generally harder to set aside than prenuptial agreements. Prenuptial agreements are typically created without the assumption of impending divorce, whereas post-nuptial agreements indicate a clear awareness that the marriage may be in trouble. The discussion highlights the legal implications and distinctions between the two types of agreements.

Postnuptial agreements have become common in recent years, and they are honored and enforceable in most U.S. states. 1 Most postnups are mostly about money and protecting assets in the case of a divorce, and postnups may be written when a couple is in crisis or concerned about the state of their union.
This can be done through a postnuptial agreement, which is an agreement you can enter into with your spouse after youre already married. Like a prenup, a postnup can be modified later if both parties agree to the changes.
Postnuptial agreements must be in writing. Voluntary Both parties to a postnuptial agreement must have signed the agreement voluntarily and intentionally. Any indication that one spouse coerced or threatened the other into signing will make a postnuptial agreement null and void.
Although all states allow you to revoke a prenuptial agreement, some do not allow you to modify the agreement after marriage, and a postnuptial agreement will have limited or no effect. Some states dont officially recognize the legal validity of postnuptial agreements.
Generally, a postnuptial agreement is for financial and property matters. It cannot be used to determine such things as child custody, visitation, or support.

Note that a prenuptial agreement cannot be modified in California if you are legally separated from your spouse or in the process of getting a divorce. You may only modify a prenup before you are wed or during your marriage, and only with the cooperation of your spouse.
A prenuptial agreement does not cover the following: Child custody or visitation matters. Child support. Alimony in the event of a divorce. Day-to-day household matters. Anything prohibited by the law.
